Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines prohibited content and behavior when using CallMeLater and Memline. By using the Services, you agree to comply with this policy.


1. Prohibited Content

You may not use the Services to create, store, transmit, or distribute content that:

  • Is illegal under Belgian, EU, or applicable local law
  • Is defamatory, libelous, or fraudulent
  • Harasses, threatens, or incites violence against any person or group
  • Contains sexually explicit material involving minors
  • Promotes hate speech, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Contains malware, viruses, phishing content, or other harmful code
  • Infringes intellectual property rights, including copyrights, trademarks, or patents

2. Prohibited Behavior

You may not:

  • Send spam — unsolicited bulk messages, commercial advertisements to recipients who have not opted in, or messages violating CAN-SPAM Act, GDPR, or ePrivacy Directive
  • Automate scraping or data extraction — use bots, scrapers, or automated tools to extract data from the Services or third-party systems without authorization
  • Perform credential stuffing or brute-force attacks — attempt to gain unauthorized access to accounts or systems
  • Launch denial-of-service (DDoS) attacks — overwhelm the Services or third-party systems with excessive requests
  • Impersonate others — misrepresent your identity or affiliation, or spoof sender addresses
  • Bypass security measures — circumvent authentication, rate limits, quotas, or other restrictions

3. Recipient Consent Requirement

When you send reminders via email or SMS, you warrant that:

  • All recipients have consented to receive messages from you (explicitly or contextually)
  • You will honor opt-out requests immediately
  • You will not send reminders to recipients who have blocked you or unsubscribed
  • You comply with all applicable data protection and electronic communication laws (GDPR, ePrivacy Directive, LCEN, CAN-SPAM Act, TCPA)

You are the data controller for recipient data. Canell SRL acts as a data processor and is not responsible for your compliance with recipient consent requirements.


4. Volume Limits

You must respect the rate limits and quotas specified for your plan. Excessive usage may trigger throttling or suspension.

Metrics that may trigger enforcement action:

  • Bounce rate > 5% — indicates invalid recipient data or lack of consent
  • Complaint rate > 0.1% — indicates recipients marking your messages as spam

If you exceed these thresholds, we may:

  • Request that you review and clean your recipient list
  • Suspend email/SMS delivery until the issue is resolved
  • Terminate your account for repeated violations

5. Commercial Marketing

Commercial marketing (promotional messages, newsletters, advertisements) is:

  • Not allowed on the Free plan
  • Allowed on paid plans only to recipients who have explicitly opted in (documented consent required)

Transactional reminders (appointment confirmations, order updates, account notifications) are permitted on all plans.


6. SMS-Specific Rules

When sending SMS reminders, you must comply with:

  • GSMA guidelines — no spam, no misleading sender IDs, no premium-rate scams
  • TCPA (United States) — prior express written consent required for marketing SMS
  • eIDAS sender ID rules (EU) — sender ID must accurately represent your identity

You may not send SMS to:

  • Emergency numbers (911, 112, etc.)
  • Premium-rate numbers without authorization
  • Recipients who have opted out or are on Do Not Call registries

7. Enforcement

Canell SRL reserves the right to investigate suspected violations of this AUP. Enforcement actions may include:

  • Warning — a formal notice to cease the prohibited activity
  • Throttling — temporary reduction of rate limits
  • Suspension — temporary account suspension pending investigation
  • Termination — permanent account termination for severe or repeated violations

We may take action without prior notice if:

  • The violation poses an immediate security risk
  • We are required to do so by law or court order
  • The violation involves illegal content or activity

Serious violations (illegal content, fraud, abuse) may be reported to law enforcement authorities.
